1. Definitions

Transport Talent operates a platform that connects talents with a background in freight forwarding, logistics or supply chain management with suitable employers. When you register on our website as an employer or talent, you create an account that gives you access to our platform. Users can view job offers as a talent and save potential employers as favorites. Employers can publish vacancies and track activities of talents. This document governs the relationship between Transport Talent and you by defining the conditions of use of the platform.

2. Legal

Nothing in these terms and conditions creates a partnership or joint venture between Transport Talent and other parties. We are an independent provider of services to you and are not employed by you. In order to use the platform services, every employer or talent must register on our website. We may accept or reject an application for registration at our discretion and may suspend or cancel registration at any time if an employer or talent violates these terms. We use the information you provide (including but not limited to sensitive personal information) to support the recruitment process and related administrative functions. This includes processing and storing information (including, without limitation, sensitive personal data) and sharing or making such information available to prospective employers. We use third parties to process your information as part of the recruitment process. We may collect and aggregate data from the information you provide to understand our users as a group so that we can provide you with better service. We may also share aggregated information with selected third parties without disclosing individual names or identifying information. You agree that Transport Talent may use the information you provide (including without limitation sensitive personal information) in any of these ways. We process all data you provide when filling out the online registration or application forms as well as other forms, evaluations or personal data you provide when using the website in accordance with GDPR. You can find out more about your personal data in our privacy policy. Transfers outside the European Economic Area (EEA): Personal information containing your CV may be accessed by third parties outside the EEA via the Transport Talent Database. This may be the case, for example, if you apply for a job where the employer is based outside the EEA. By registering and using the Website, you consent to this transfer. The rights to the material on our website are protected by international copyright, software and trademark laws, and you agree to use the website in a manner that does not infringe these rights. You may copy material on our website for your own private or domestic use, but not for commercial or business purposes. To register on our website and log in when you visit our website, you must use a user name and password. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and should not be disclosed to any third party. You must notify us immediately if you believe that your password has become known to anyone else or if it is likely to be used in an unauthorized manner. We accept no liability for unauthorised or improper use or disclosure of passwords. We may terminate your membership and/or deny you access to our website or any part of it (including any services, goods or information available on or through our website) at any time in our absolute discretion and without any explanation or notification. We accept no liability for any loss (whether direct or indirect, loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or any other indirect or consequential loss) arising from your use of our website and we hereby exclude all liability whether in contract, tort (including negligence) or otherwise. We hereby exclude all representations, warranties and conditions with respect to our website and your use of the website to the fullest extent permitted by law. You agree to indemnify and hold us harmless from any costs, expenses, claims, losses, liabilities or proceedings arising out of your use or misuse of our website. You must notify us immediately if anyone makes or threatens to make a claim against you in connection with your use of our website. The use of our website and all contracts concluded via our website are subject to German law and must be interpreted accordingly. The German courts shall have exclusive jurisdiction for all disputes arising out of or in connection with the use of our website or any agreement entered into through our website.

3. Obligations

While using Transport Talent, you will not perform any of the following actions: Violate any laws, third party rights or our policies, such as the Terms of Use; Bypass or manipulate our fee structure, the billing process, or the fees owed to Transport Talent; Post false, inaccurate, misleading, fraudulent, defamatory or offensive content (including personal information); Transfer your account and username to another party without our consent; Distributing or posting spam, unsolicited or bulk email, chain letters or pyramid schemes; Distributing viruses or other technologies that may harm Transport Talent, the Website, or the interests or property of Transport Talent users (including their intellectual property rights, privacy and publicity rights) or that are unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, blasphemous, harassing, or likely to incite hatred of any person; Modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software programs used by us in connection with our website; Collecting information about users, including e-mail addresses, without their consent or otherwise. The Employer undertakes to notify Transport Talent immediately when a job offer has been accepted by an applicant and the date of entry has been confirmed, so that Transport Talent can calculate the placement fee in accordance with the conditions specified. The employer undertakes to confirm the suitability of a candidate for the purposes of the vacancy. The employer is recognized to verify the truthfulness of a candidate's application and it is the employer's responsibility to check references, perform additional checks such as criminal record checks, validation of the candidate's qualifications and ensure that the candidate is able to meet the requirements of the vacancy. The employer is responsible for ensuring that the talent obtains all necessary work permits and other approvals, and for ensuring that the talent meets any medical requirements or other qualifications required for suitability or required by law. The Employer agrees that best practices for keeping confidential data confidential will be used within the Platform. The employer will owe the placement fee if a talent is referred to the employer and initially rejected, but is subsequently hired by the employer in the same or similar positions within twelve months of the initial introduction. The employer is liable to pay the placement fee if a talent is transferred and hired by Transport Talent to another company or firm, including a subsidiary, affiliate or holding company of the employer, within six months of the initial introduction. The Employer authorizes Transport Talent to fully disclose information about the Employer to talents provided to Transport Talent by the Employer. In the event that the employer has previously received the resume of a candidate who has also applied for the same job via the platform, the employer must provide proof that the candidate has first applied directly to the employer. In this case, Transport Talent will reimburse the placement fee (if a settlement has been made) if the talent can prove that he or she has applied directly or indirectly for the same job. The Employer agrees that Transport Talent may use its logo and company name on the platform and may provide its users with publicly available information about the company.
